Minichamps GmbH & Co. KG (hereinafter: "Minichamps" or "we") takes the protection of your personal data very seriously. We would like to inform you comprehensively about which of your data we collect on www.minichamps.de and for what purposes we use them.

2. Data Processing when Creating a Customer Account
With an account on www.minichamps.de you can, among other things, view previous orders, manage your data and maintain wish lists.
When you create an account on www.minichamps.de, we collect the data provided by you in the registration form. The contact data marked with an asterisk are mandatory information without which an account cannot be created (in particular first and last name, address, e-mail address). All other information is voluntary. If you provide your date of birth, we can send you special birthday offers, provided you also subscribe to our newsletter.
The legal basis for processing is Art. 6 (1) sentence 1 lit. a GDPR based on your voluntarily given consent. You may revoke this consent at any time. For this purpose, you can contact us at any time. For example, an e-mail to the address provided above is sufficient. If you revoke your consent, we will no longer be permitted to continue in the future the data processing that was based on this consent. The lawfulness of the processing carried out until revocation remains unaffected, i.e. the processing carried out in the past on the basis of the consent remains lawful. This means that we will delete your customer account and the data processed for this purpose. The further use of data stored with us for other purposes and for whose processing we are legally entitled on a different legal basis (e.g. with regard to data required for contract execution) remains unaffected.
3. Data Processing for Orders via the Online Shop
When you place an order via our online shop, we process your data to fulfil the contract, in particular for order processing, communication, invoicing as well as customer support, handling of warranty claims, enforcement of claims for contract performance, etc.
This data comprises the contact details required for processing and delivering your order and for invoicing (first and last name, address, telephone number and e-mail address), information on the ordered products (item, price, quantity, shipping costs) and the type of payment method you have chosen (e.g. bank transfer, credit card).
The legal basis for processing is Art. 6 (1) sentence 1 lit. b GDPR, as the data processing is necessary for the performance of the contract with you or for pre-contractual measures based on your enquiry.
Insofar as this is necessary for the fulfilment of the contract concluded with you, we are entitled to pass on your data. For example, we transfer your personal data to the shipping company commissioned by us to deliver the order.
The purpose of the data transfer is the execution of the contract. The legal basis for the transfer of your data is Art. 6 (1) sentence 1 lit. b GDPR.
Insofar as payment is processed via a payment service provider, we do not collect or store any payment transaction information such as credit card numbers or bank details. You provide these exclusively directly to the respective payment service provider that processes your payment and is subject to special security requirements. In this context, the payment service provider carries out a security check based on transaction characteristics in order to avoid difficulties in payment processing and cases of fraud.
In exceptional cases, we store a so-called pseudo card number for credit card payments: so that you do not have to re-enter your credit card details for every payment transaction, a pseudo card number differing from your credit card number is stored in your account. Using this pseudo card number, the payment service provider can process payments via your credit card that are ordered from your account on minichamps.de.
Credit card payments are processed via the payment service provider Unzer GmbH, Vangerowstr. 18, 69115 Heidelberg.
For the processing of credit card payments, Unzer GmbH cooperates with the acquirer:
HUELLEMANN & STRAUSS ONLINESERVICES S.A.r.l.
1, Place du Marché
L-6755 Grevenmacher
E-mail: info@hso-services.com
The payment service provider is solely responsible for the processing of your personal data in connection with the payment. In this respect, only the data protection policies of the respective payment service provider apply.
5. Use of Cookies
When you visit our website, both first-party cookies (from the domain www.minichamps.de) and third-party cookies (e.g. from providers of social networks) are set in your browser. Cookies are text files that can be used to identify your browser. With the help of our first-party cookies, we can make our website convenient for you, for example in the form of preferences for the language used on our website or for the shopping cart function. Cookies can only be used by the domain that originally set them. Accordingly, we only read out first-party cookies, but not third-party cookies. Our first-party cookies are session cookies limited to the respective browser session and are deleted when the browser is closed or after prolonged inactivity. We have no influence on the use and storage of third-party cookies. You can find further information on this in the following sections on social plugins and Google Analytics.
You can configure the handling of cookies in your browser settings, for example, disable the storage of cookies or delete all cookies when the browser session ends. Please consult the manufacturer of your browser for options to control the handling of cookies by your browser. Third-party providers also offer extensions for commonly used browsers for this purpose. Please note that individual functions of our website may be available only to a limited extent or not at all if you disable the use of cookies.
6. Use of Social Plugins
On our websites we offer you plugins from various social networks. The plugins from Facebook and Google+ are integrated directly. We provide additional plugins via the AddThis service. The operators of these services are:
Facebook: Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA
Google+: Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA
AddThis: Clearspring Technologies, Inc., 1595 Spring Hill Rd, Suite 300, Vienna, VA 22182, USA
Your browser loads these plugins directly from the operators' servers in order to display them on our websites. In doing so, the IP address of your internet connection or of the device used by you is transmitted to the operator's server, along with information about the page of our website from which you accessed the plugin. In addition, the social network may set cookies in your browser.
If you are logged in as a user to the respective social network when accessing the plugin, the operator may associate the information with your personal user account on the respective social network. If you use the functions of the offered plugins (e.g. by clicking the Like button or the +1 button, or by submitting a comment), this information will also be associated with your user account on the respective social network. If you want to prevent the association of information with your user account on the social networks you use, we recommend that you log out there before visiting our websites. However, you may then be unable to use the functions of the plugins, or use them only to a limited extent.
You can find more information about the collection and use of data by the operators of the plugins on their websites at:
Facebook: http://www.facebook.com/about/privacy/
as well as http://developers.facebook.com/docs/plugins/
Google+: https://www.google.de/intl/de/policies/privacy/
AddThis: http://www.addthis.com/privacy
If you are interested, please consult the manufacturer of your browser for options to adjust your browser's privacy settings and thereby, for example, control the handling of cookies. Third-party providers also offer browser extensions to control the use of cookies and to prevent behaviour-based advertising. AddThis offers an opt-out option here: http://www.addthis.com/privacy/opt-out
7. Google Analytics
This website uses Google Analytics, a web analytics service provided by Google Inc. (Google). Google Analytics uses so-called cookies, text files that are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie about your use of this website is generally transmitted to a Google server in the USA and stored there. If IP anonymisation is activated on this website, however, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide the website operator with further services related to website and internet use. The IP address transmitted by your browser as part of Google Analytics is not merged with other Google data. You can prevent the storage of cookies by adjusting your browser software settings accordingly; however, we would like to point out that in this case you may not be able to use all functions of this website to their full extent. In addition, you can prevent the collection of the data generated by the cookie and related to your use of the website (including your IP address) by Google, as well as the processing of this data by Google, by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=en
We use Google Analytics to design our website in line with demand and to continuously optimise it. In addition, we use the tracking measures to statistically record the use of our website and to evaluate it for the purpose of optimising our offering for you. These interests are to be considered legitimate within the meaning of Art. 6 (1) sentence 1 lit. f GDPR.
Google Fonts:
For the uniform display of fonts, Google Web Fonts are used on our website. When you access a page, your browser loads the required fonts from Google into its browser cache in order to display texts and fonts correctly. In doing so, your IP address and possibly further information are generally transmitted to a Google server in the USA and stored there. In this way, Google becomes aware that our website has been accessed via your IP address. Further information about Google Web Fonts can be found at https://developers.google.com/fonts/faq and in Google's privacy policy: https://www.google.de/intl/de/policies/privacy/.
If Web Fonts are not supported by your browser, a standard font on your computer will be used. The use of Google Web Fonts is in the interest of a uniform and appealing presentation of our online offerings. This constitutes a legitimate interest within the meaning of Art. 6 (1) lit. f GDPR.
8. Pseudonymised Usage Profiles
Insofar as legally permissible, we may create and evaluate usage profiles under pseudonyms for the purposes of advertising, market research and needs-based design of our website, but only insofar as you do not exercise your statutory right to object at any time to this use of your data.
9. Newsletter
We are happy to send you our newsletter if you subscribe to it. For this purpose, we collect and use your e-mail address only with your express consent, which you may revoke at any time using the contact details provided. Even more simply, you can unsubscribe from the newsletter under the Newsletter menu item or in your account, or by clicking the unsubscribe link that you will find in every newsletter.
For sending the newsletter we use MailChimp, a service of The Rocket Science Group LLC, Georgia/USA, with whom we have concluded a data processing agreement pursuant to Art. 28 (3) GDPR. The data processing is subject to the provisions of the EU/U.S. Privacy Shield Framework.
10. Your Rights of Revocation and Objection
We will always ask for your consent where this is legally required so that we may use your data. You may revoke a consent at any time with effect for the future using the contact details provided in this privacy policy.
If the legal requirements are met, we may also use your data without your express consent for the purposes of advertising or market or opinion research. You may object at any time to the use of your data for the purposes of advertising, market or opinion research using the contact details provided in section 1 of this privacy policy.
The implementation of a revocation or an objection may take some time for technical reasons, during which you may still receive messages from us.
11. Contact Form
If you contact us via our contact form, by e-mail or otherwise and provide information in doing so, we will store and use this information so that we can attend to your request.
12. Logging of Access in Log Files
For technical reasons, the following are stored in a log file each time our website is accessed:
Name of the file accessed
Date and time of the access
Volume of data transferred
Message on whether the retrieval was successful
IP address from which the access was made
We use this log data to detect, isolate or eliminate technical faults or errors and to detect and defend against attacks on the technical infrastructure of our online offering as well as any other unlawful misuse. This also serves to protect your personal data. Log files are deleted after a maximum of 7 days. In cases of suspicion, we reserve the right to retain excerpts for longer until the matter is finally clarified.
13. Other Storage and Transfer of Personal Data
In addition, we may make personal data available to third parties insofar as we are legally obliged to do so or by administrative or judicial order, or insofar as this is legally permissible, if necessary after your prior information and consent, for example to exercise our rights and claims, for legal defence or for the prosecution of criminal offences.
14. Data Security
To protect your data we take effective technical and organisational measures, which we regularly review for their appropriateness and adjust if necessary. For example, the transmission of personal data via www.minichamps.de is encrypted according to the SSL standard.
15. Links to Websites of Other Companies
Insofar as you can access websites of other companies via www.minichamps.de, please note that we are not responsible for the data protection arrangements of these companies. You can obtain more detailed information from the companies concerned.
16. Right to Information, Correction, Blocking, Deletion
Within the framework of the applicable statutory provisions (Art. 15 EU GDPR in conjunction with Section 34 BDSG), you have the right at any time to obtain free information about your personal data stored with us, their origin and recipients and the purpose of the data processing, and, where applicable, a right to correction (Art. 16 EU GDPR), blocking (Art. 18 EU GDPR) or deletion (Art. 17 EU GDPR in conjunction with Section 35 BDSG) of this data. You may object at any time to the use of your data for advertising and market research purposes.
You can exercise these rights against Minichamps GmbH & Co. KG by contacting us directly at info@minichamps.de. Furthermore, you may also address your request in writing to the aforementioned address.
Right to data portability
You have the right to have your data, which we process automatically, delivered to yourself or to a third party in a commonly used, machine-readable format. If you request the direct transfer of the data to another controller, this will only take place insofar as it is technically feasible.
17. Changes to this Privacy Policy
In the course of further development of the offerings on our website, in order to improve our service for you or for technical reasons, adjustments to this privacy policy may become necessary. Please therefore review this privacy policy from time to time for changes. If such changes require your consent, we will inform you in good time before they take effect.
